Frequently asked question (FAQ)

Never let things drag on. The earlier we intervene, the greater the chances of recovery! If your debtor doesn’t react after having received your first reminder or formal registered demand, it’s then time to let FIDUSUD look after your unpaid debts..

The debtor will so realize that his creditor does not intend to wait anymore and that it is preferable for him to react as soon as possible.

The file transfer to FIDUSUD can be done by post or by Internet  (email, FTP server,…). The client will commit himself to provide Fidusud with:

  • A copy of the documents justifying the debt
  • A detailed account of the amounts due
  • A copy of the correspondence in the file
  • The story of the file

In general the amounts collected by Fidusud are transferred at the end of each month. You will receive a detailed account of the collected amounts that will enable you to correctly enter these in your accountancy. The frequency of the transfers can possibly be adapted depending on the number of files transmitted to Fidusud.

Fidusud is one of the founder members of the ABR (Belgian Collectors Association) and therefore scrupulously respect the code of conduct of that association which aims at defining the guidelines in matter of amicable settlement of disputes by excluding from the profession the less reliable companies.

As a result, by calling upon FIDUSUD, you have the guarantee of a correct recovery of your debts, in the respect of the law. However, Fidusud will make sure that the debtors don’t forget that besides their rights, they also have obligations to respect.

We always operate in the strict respect of the private life and under the control of the Federal Public Service Economy.

To give you the opportunity of following the evolution of each file you asked us to manage, FIDUSUD proposes you, by the means of a secured connection, to have access to the various financial operations occurred within the framework of the file in question (see Extranet).

Fidusud will try to contact the debtor through all available communication ways (registered letters or not, phone calls, sms, mails). We also search for missing debtors and visit at the address when needed.

We consider this step as being the ultimate attempt to settle the problem out of court. In function of the result, we will decide whether giving up the proceedings or, on the contrary, starting the legal procedure.

As far as possible, Fidusud tries to settle disputes out of court but this doesn’t always prove to be possible. In such a case Fidusud can invite you to go before court with the aim of obtaining the sentencing of your debtor to the payment of debt and can completely deal with the administrative follow-up of the file (contacts with lawyers and bailiffs) while always having the protection of your interests in mind.

As in each job, we can find on the collecting market reliable companies and some (less numerous) which are less dependable. A distinction has therefore to be made.

The media and the press in particular often tend to lay into the collection offices tooth and nail, but they are often unaware of different aspects of the issue and unfortunately make generalities from isolated cases! Anyway the law on the amicable settlement of disputes clearly aims at pushing aside the less scrupulous collecting actors.

Fidusud’s first goal is to come to a fair solution while taking two aspects into account: the protection of the creditor’s interests on the one hand and the debtor’s situation on the other hand! If the debtor shows great willingness, we will naturally take this in consideration but if this is not the case, we will take the necessary measures while always respecting the law of 20 December 2002 on the amicable settlement of disputes (we are behind that law) and the ABR’s professional code of ethics.
